Kagan Confirmation Will Stir Controversy1 comment

SIDESWIPE – The confirmation of Elena Kagan to the Supreme Court last week was never in doubt given the Democrats’ majority in the Senate.  Equally, few observers of the U.S. political and justice systems have any doubt that Ms. Kagan will be a politically liberal judge legislating from the bench, rather than one who upholds the constitution in the mold of her more conservative colleagues.  A crucial first test of her judicial activism (or impartiality) will involve ruling on the constitutionality of the unpopular ObamaCare, which is being challenged by numerous states.  No prizes for guessing where her loyalties will lie.  The president’s former Solicitor General has already indicated that she will not recuse herself from this case.  She says that she did not provide legal advice to the administration when the law was crafted.  We can only imagine the outcry in the liberal media if a Bush nominee had brushed aside concerns about a conflict of interest in such a groundbreaking and controversial case.  In contrast to the niceties of her confirmation ceremony, controversy looks sure to quickly catch up with the newest member of the Supreme Court.

    Both Lindsay Graham and Richard Lugar voted to confirm Elena Kagan. Senator Graham’s remarks that the words of “Jesus” helped him decide are both blasphemy and counter to the principles of the founding fathers. God would never endorse someone who supports abortion and Kagan will without a doubt be a judicial activist. Either Senators Graham and Lugar are closet liberals or they are naive and have their ability to govern, and protect our nation from the onslaught of socialism/communistic/Liberal tide that is sweeping our nation. The short sightedness of those Republicans and conservative Democrats will destroy our Republic and usher in an era of oppressive governance. Benjamin Franklin was correct when asked by a group of citizens, what kind of government have you given us? “A Republic if you can keep it.” The answer seemed to have foretelling of a newly born nation. If we are not vigilant we will lose the rights granted to us by God and our nation’s Constitution.

    Americans are neither rash nor quick to respond to assault son their freedoms. However, there is a flashpoint by which they will either vote out an incumbent Congress or if that path does not inspire change in government, there may also be another type of wave which will lead to the shedding of the blood of patriots and tyrants. Although, I am not advocating the latter if we have not learned from our history we may be doomed to repeat it once more. Thomas Paine wrote “These are the times that try men’s souls.” Written in The Crisis, it seemed to describe the beginning of the American Revolution. Our nations once fought a war of independence, are we destined to fight another war of independence but an internal one? Has tyranny taken a foothold in our nation and our elected officials taken office only to enrich themselves and suppress the citizens of these United States? Have we lost those who championed to prevent our Republic from being usurped by those who wish to turn us into the second coming of a corrupted European continent?
